Colombian company lost trial with CROCS


A new legal argument penalized the Colombian industry.

EVACOL del Valle del Cauca, Colombia, manufacturer of EVA clogs, was sanctioned by the Superintendence of Industry and Commerce, for having infringed the intellectual property right that CROCS owns for the design of those products. The cost for EVACOL was the confiscation of 54 thousand pairs of shoes, the destruction of matrices and the payment of US $ 23 thousand for compensation and damages.

The legal argument of the lawsuit where the Colombian company was losing was the "three-dimensional mark" which is the distinctive sign characterized by a volumetric form, where users link a form with a certain product.

Thus, the Colombian agency granted the three-dimensional trademark registration to the US company, which may extend it every 10 years.
